These Terms and Conditions are a legally binding agreement made between you, whether personally or on behalf of an entity, concerning your access to and use of the services and products provided. You agree that by accessing the products and services that you have read, understood, and agree to be bound by all of these Terms and Conditions. IF YOU DO NOT AGREE WITH ALL THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND/OR PRODUCTS AND YOU MUST DISCONTINUE USE IMMEDIATELY. 

 

We reserve the right, at our sole discretion, to make changes and modifications to these terms at any time and for any reason. We will alert you about any changes by updating the ‘last updated’ date of these terms and you waive any right to receive any notice of such change. It is your responsibility to periodically review these terms to stay informed of updates. You will be subject to and deemed to have been made aware of and to have accepted the change in terms by your continued use of the services and/or products after revised terms are posted.

Prohibited Activities

You may not access or use the services and/or products for any purpose other than that for which we make the services and/or products available. The services and/or products may not be used in connection with any commercial endeavours except those that are expressly endorsed or approved by us.

• disparage, tarnish or otherwise hard, in our opinion, us or our services and/or products

• use any information contained from the services and/or products in order to harass, abuse, or harm another person

• make improper use of our support services and/or products or submit false report of abuse or misconduct

• use the services and/or products in a manner inconsistent with any applicable law or regulations

• engage in unauthorized framing of or linking to the services and/or products

• upload or transmit (or attempt to transmit) viruses, trojan horses, or other material, including excessive use of capitals letters and spamming that interferes with any party’s uninterrupted use and enjoyment of the services and/or products or modifies, impairs, disrupts, alters or interferes with the use, features, functions, operations, or maintenance of the services and/or products

• engage in any automated use of the system such as using script send comments or messages or using any data mining, robots or similar data gathering and extraction tools

• delete the copyright or other proprietary rights notice from the content

• upload or transmit (or attempt to upload or transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formation, web bugs, cookies, or other similar devices.

• interfere with, disrupt, or create an undue burden on the services and/or products the networks or services connected to the services and/or products

• harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the services and/or products to you

• attempt to bypass any measures of the services and/or products designed to prevent or restrict access to the services and/or products, or any portion of the services and/or products

• copy or adapt the services and/or products software, including but not limited to Flash, PHP, HTML, JavaScript or any other code

• except as permitted by law, decipher, decompile, disassemble, or reverse engineer any of the software comprising in any way making up a part of the services and/or products

• except as may be the result of standard search engine or internet browser usage, use, launch, develop, or distribute any automated system, included without limitation, any spider, robot, cheat utility scraper, or offline reader that accesses the services and/or products, or use or launch unauthorized script or other software

• use a buying agent or purchasing agent to make purchases on the services and/or products

• make unauthorised use of the services and/or products, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating accounts by automated means or under false pretences. 

• use the services and/or products as part of any effort to compete with use or otherwise use the services and/or products and/or content for any revenue-generating endeavour or commercial enterprise. 

 

Services management

We reserve the right but not the obligation to (1) monitor violations of these terms (2) take the appropriate legal action against anyone who, in our sole discretion, violated the law or these terms (3) in our sole discretion and without limitation refuse, retract access to, limit the availability of, or disable use of services and/or products (4) in our discretion and without limitation notice or liability to remove from our services and/or products or disable files that are excessive in or are in anyway burdensome to our system and (5) otherwise manage the services and/or products in a manner designed to protect our rights and property and facilitate the proper functioning of our services and/or products.

 

Term and Termination

These terms remain in full force and effect while you use our services and/or products. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETIONS AND WITHOUT NOTICE OF LIABILITY, DENY ACCESS TO AND USE OF THE SERVICES AND/OR PRODUCTS TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENT, WARRANTY, OR CONVENANT CONTAINED IN THESE TERMS OR OF ANY APPLICABLE LAW OR REGULATION, WE MAY TERMINATE YOUR USE OR PARTICIPATION OF THE SERVICES OR DELETE ANY CONTENT OF INFORMATION, WITHOUT WARNING AND IN OUR SOLE DISCRETION.

 

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress. 

Modifications and interruptions

We reserve the right to change, modify or remove the contents of the services and/or products at any time for any reason at our sole discretions without notice. However, we have no obligation to update any information on our services and/or products. We will not be liable to your or any third party for any modifications, price change, suspension, or discontinuance of the services and/or products. 

 

We cannot guarantee the services will be available at all times. We may experience hardware, software, or other problems which we need to perform maintenance in relation to the services and/or products, resulting in interruptions, delays, discontinuance or otherwise modify the services and/or products at any time for any reason without reason to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience to you caused by your inability to access the services and/or products during downtime or discontinuance of the services. Nothing in these terms will be construed to obligate us to maintain and support the services or supply corrections, updates, or release in connection therewith. 

 

Dispute resolution

Disputes will be resolved initially by informal negotiations (within 30 days) followed by binding arbitration. 

 

Payment terms 

Customers will pay the full amount online at point of purchase

 

Delivery and Receipt of Products

Customers will receive their download for their purchased online product. It is the responsibility of the client to download the product for use. If there are technical issues with downloading the content they will get in contact. Additionally, if they require a printable black and white version of their purchased online product, they will request this via email. They will be issued with this if there is proof of purchase of the original online product.  

 

Returns and Refunds

We stand behind our products, believe in their quality and your satisfaction with them is important to us. However, because our products are digital goods delivered via Internet download, we generally offer no refunds. 

 

Refund requests made after you have downloaded our product are handled on a case-by-case basis and are issued at our sole discretion. Refund requests, if any, must be made within ten (10) days of your original purchase.

 

Warranties and Liability

The Company warrants that the product(s) created, sold, and delivered by the Company to the customer shall be free from defects, conform to applicable specifications, and perform in accordance with the product documentation. The company are not responsible for any product warranties or warranty-related claims.

The company does not take responsibility for any inaccuracy in any information shared on the website.

ALL COACHES AT JB PAL ARE RELEASED FROM ANY LIABILITY IN THE UNLIKELY EVENT OF AN INJURY OR DAMAGES THE CUSTOMER MAY SUSTAIN AS A RESULT OF PARTICIPATION IN OR PURCHASE OF THE FITNESS PLANS/PROGRAMS. 

 

Data Protection and Privacy

Data is collected in compliance with GDPR laws in the UK. 

Endeavours like, but not limited to filling orders and marketing forms will result in collection of information such as name, email, address, and payment details. We collect the Internet Protocol address used to connect your computer to the internet. We collect login information such as email address, password, computer and connection information and purchase history. We may use software tools to measure, collect and analyse information such as time spent on pages, page response times, page interaction information. The above information is collected to provide and operate services, allow ongoing customer support, contact information with personalised service notices, compile aggregated statistical data and to comply with laws and regulations. 

 

We collect personally identifiable information such as name, email, password, payment details, comments, and feedback. Information is collected when transactions are completed and used only for this purpose. 

 

In addition to this personal information about medication, health and fitness levels will be collected when using the fitness services. Data will be stored on a secure password protected device, within a password protected website account that only those with express online permission will have access to. No data will be shared with third parties unless express permission from clients is given, and only, when necessary, in instances such as sharing information with other professionals or medical personnel. Customers can request deletion of any information at any time and have permissions to delete their own information held on their member’s page. 

 

JB PAL is hosted on the Wix.com platform, allowing us to provide our services and or products to you. Your data may be stores through the WIX data storage, databases, and applications. All data is stored on secure serves behind a firewall. 

 

All direct payment gateways adhere to the standards set by PCI-DSS, managed by PCI Security Standards Council, which is a joint effort of brands such as Visa, MasterCard. This ensures any card information is handled in a secure manner.

We reserve the rights to modify this privacy policy at any time, it is your responsibility to review it intermittently. Changes and clarifications will take place immediately upon posting. Cancellation Rights

When using our services, cancellations with full refund will be accepted up to 24 hours before the start date and time. Cancellations within this timeframe will result in a full refund. Late cancellations will not be accepted.
